Keysight Terms and Conditions - Belgium

Applies to quotes issued by and orders booked with Keysight Technologies Belgium BVBA

Terms referenced and documents attached to the Keysight quotation apply to your purchase of hardware products, services and license to software (“Items”). The Keysight Terms of Sale also apply to purchase of Item(s) unless the Item(s) falls under one or more of the following conditions:

• Repair, maintenance, and support services purchased subsequent to your purchase of Keysight Items or third party Items, Keysight Terms of Service shall apply.
• Items with "(SOLN)" in the product description, Keysight Terms of Sale for Solutions shall apply.
• Items described in the quotation as KeysightCare, Basic/Essential/Enterprise or Silver/Gold/Platinum Support, Keysight Terms of Sale and KeysightCare, Basic/Essential/Enterprise and Silver/Gold/Platinum – Support Terms and Conditions shall apply.
• For Items with ESI in the product description, Computer Aided Engineering (ESI) Software Support and Maintenance Terms shall apply.
• For items with ODE or PowerArtist in the product description, Support and Maintenance Terms for Optical Design Engineering Software Products and PowerArtist shall apply.
• Items manufactured, modified or adapted by Keysight to meet your requirements as defined in a Statement of Work (SOW), Keysight Terms of Sale for Custom Products shall apply.
• Used Items purchased in response to a bid made by you in an auction offered by Keysight, Keysight Terms of Sale for Remarketed Products shall apply.
• Self-paced training modules purchased for electronic delivery and Keysight hosted training delivered through the web or in person at a Keysight facility, eLearning and Keysight Hosted Training Exhibit and Keysight Terms of Service shall apply.
• Training delivered by a Keysight instructor at your facility and consulting services, Keysight Consulting Services Terms and Conditions shall apply.
• Purchases of education and training, Keysight Customer Education and Training terms shall apply.
• For Items with Eggplant in the product description, Keysight Terms of Sale for Eggplant Software Licenses and Services shall apply.
  
• Items described in the quote as On-Premises, Cloud or SaaS, the Keysight On-Premises, Cloud (SaaS), and Services Terms and Conditions shall apply.

Les Termes référencés et les documents joints l’offre de prix de Keysight s’appliquent à votre achat de matériel hardware, services et licences de logiciel («Produits»). Les Conditions Générales de Vente de Keysight s’appliquent également à l’achat de Produit(s) à moins que le(s) Produit(s) relève(nt) de l'une ou plusieurs des conditions suivantes:

• Les services standards ou personnalisés achetés suite à votre achat de matériel hardware ou de logiciel Keysight ou de tiers, sont soumis aux Conditions Générales de Service de Keysight.
• Les Produits comprenant la référence “(SOLN)” dans la description du produit sont soumis aux Conditions Générales de Vente de Solutions de Keysight.
• Produits décrits dans le devis comme KeysightCare, Basic/Essential/Enterprise ou Silver/Gold/Platinum Support, les Conditions de Vente de Keysight ainsi que les Conditions de Support KeysightCare, Basic/Essential/Enterprise et Silver/Gold/Platinum s’appliquent.
• Produits ayant “ESI” dans la description du produit, les Conditions de Support et de Maintenance des Logiciels d’Ingénierie Assistée par Ordinateur (ESI) s’appliquent.
• Produits ayant “ODE” ou “PowerArtist” dans la description du produit, les Conditions de Support et de Maintenance pour les Produits Logiciels d’Ingénierie de Conception Optique et PowerArtist s’appliquent.
• Les Produits fabriqués, modifiés ou adaptés par Keysight pour répondre à vos exigences telles que définies dans un énoncé des travaux (SOW), sont soumis aux Conditions Générales de Vente pour Produits Personnalisés de Keysight.
• Produits d’occasion achetés en réponse à une offre faite par vous dans une vente aux enchères organisée par Keysight, les Conditions de Vente de Keysight pour les Produits Recommercialisés s’appliquent.
• Les modules de formation à rythme libre achetés pour livraison électronique et les formations dispensées par Keysight via le web ou en présentiel dans les installations de Keysight, les Annexe de formation en ligne et de formation dispensée par Keysight ainsi que les Conditions de Service de Keysight s’appliquent.
• La formation dispensée par un formateur Keysight dans vos locaux et les services de conseil, les Conditions de Services de Conseil de Keysight s’appliquent.
• L’achat d’éducation et de formation est soumis aux Termes et Conditions Keysight de Formation des Clients.
• Produits ayant “Eggplant” dans la description du produit, les Conditions de Vente de Keysight pour les Licences de Logiciels et Services Eggplant s’appliquent.
• Produits décrits dans le devis comme On-Premises, Cloud ou SaaS, les Conditions Générales de Keysight pour On-Premises, Cloud (SaaS) et Services s’appliquent.

Van toepassing op offertes van en bestellingen aan Keysight Technologies Belgium BVBA.

De bij de Keysight offerte gevoegde documenten en de vermelde voorwaarden zijn van toepassing op uw aankoop van hardware-producten, diensten en softwarelicenties (“Items”). Op de aankoop van Items zijn eveneens de Verkoopvoorwaarden Keysight van toepassing, tenzij deze Items onder één of meerdere van de volgende voorwaarden vallen:

• De Keysight Servicevoorwaarden zijn van toepassing op standaard of gepersonaliseerde diensten, aangeschaft na uw aankoop van hardware of software van Keysight of van derden.
• Op aankopen van items met “(SOLN)” in de productomschrijving zijn de Keysight Verkoopvoorwaarden voor oplossingen van toepassing.
• Op Items die in de offerte worden omschreven als KeysightCare-, Basic/Essential/Enterprise- of Silver/Gold/Platinum-support zijn de Keysight Verkoopvoorwaarden en de KeysightCare, Basic/Essential/Enterprise en Silver/Gold/Platinum – Supportvoorwaarden van toepassing.
• Op Items met “ESI” in de productomschrijving zijn de Computerondersteunde engineering (ESI) software – support- en onderhoudsvoorwaarden van toepassing.
• Op Items met “ODE” of “PowerArtist” in de productomschrijving zijn de Support- en onderhoudsvoorwaarden voor Optical Design Engineering-softwareproducten en PowerArtist van toepassing.
• De Keysight Verkoopvoorwaarden voor Producten op Maat zijn van toepassing op Items die door Keysight zijn vervaardigd, gewijzigd of aangepast in overeenstemming met uw wensen zoals vastgelegd in het bestek van de werkzaamheden (SOW).
• Op gebruikte Items die u hebt aangeschaft naar aanleiding van een door u uitgebracht bod in het kader van een door Keysight georganiseerde veiling, zijn de Keysight Verkoopvoorwaarden voor wedervermarkte producten van toepassing.
• Op zelfstudie‑opleidingsmodules die zijn aangeschaft voor elektronische levering en door Keysight aangeboden trainingen die via het web of persoonlijk op een Keysight‑locatie worden gegeven, zijn het eLearning- en Keysight Hosted Training Exhibit en de Keysight Servicevoorwaarden van toepassing.
• Op trainingen die door een Keysight‑instructeur op uw locatie worden gegeven, evenals op consultancydiensten, zijn de Keysight Algemene Voorwaarden voor Consulting Services van toepassing.
• Op aankopen van opleiding en vorming zijn de Keysight Algemene Voorwaarden betreffende Opleiding Cliënt van toepassing.
• Op Items met “Eggplant” in de productomschrijving zijn de Keysight Verkoopvoorwaarden voor Eggplant-softwarelicenties en -diensten van toepassing.
• Op Items die in de offerte worden omschreven als On-Premises, Cloud of SaaS, zijn de Keysight On-Premises-, Cloud (SaaS)- en Servicevoorwaarden van toepassing.
